UNITED STATES: Finalized Federal Trade Commission Green Guides for the use of environmental marketing claims

Businesses that make environmental claims about their products, must now comply with the revised version of the Federal Trade Commission's Green Guides (Guide) which were finalized on 11 October 2012. The changes seek to provide further guidance to assist marketers in avoiding making misleading environmental claims. The revised Guide updates the existing sections and adds new sections for claims which were not common when the Guide was previously revised. These new sections are: certifications and seals of approval, carbon offsets, free-of claims, non-toxic claims, made with renewable energy claims, and made with renewable materials claims.

The FTC press release, summary, and full version of the Revised Green Guides are available on FTC’s website.
